Terms of Use

1. Your agreement with PitchTactix

These Terms govern the website and services provided by Awesome Sports & Entertainment LLC (“PitchTactix,” “we,” “us”). By using the service, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the service. If you act for a team or organization, you must have authority to do so. Mandatory consumer rights remain in effect.

PitchTactix is currently in prelaunch. A waitlist signup is not a purchase, reservation, subscription, or guarantee of early access. Features, compatible devices, and availability are described in the applicable release and purchase screen. Separate promotion rules, if provided, govern giveaways and special offers. Apple is not a sponsor of PitchTactix promotions.

2. Accounts and athlete information

Provide accurate information, protect your sign-in credentials, and promptly report suspected unauthorized access. You may use only accounts, profiles, and records you are authorized to access. Do not share account credentials to avoid plan or roster limits.

If you create or manage an athlete profile, you must be the athlete, their parent or legal guardian, or an adult with appropriate authorization. Obtain all necessary permissions before entering another person’s information or sharing their records. A coaching relationship alone does not replace legally required parental consent.

Children under 13 must not independently create an account, join the marketing list, or submit personal information. Parent or guardian involvement and any legally required verifiable consent are necessary for covered children’s information. Users who are minors must have parent or guardian permission and appropriate supervision. See the youth privacy section.

3. Training tools, Lexi, and safety

PitchTactix provides tracking, performance summaries, workouts, simulations, and software-generated coaching insights. Results depend on the accuracy of information entered. Virtual Game outcomes are simulations; Lexi’s suggestions can be incomplete or wrong. Review recommendations with a qualified coach and use your judgment.

PitchTactix is not a medical service and does not diagnose, treat, or prevent injury. It does not replace medical advice, emergency services, or an in-person assessment. Choose an appropriate training environment, supervision, rest, and workload. Stop activity that causes pain, dizziness, numbness, or unusual discomfort and seek appropriate professional care. No athletic improvement, scholarship, recruitment, team selection, or other particular result is guaranteed.

4. Plans, billing, and cancellation

Free and paid plans provide the features and limits described at the time of enrollment. Review the total price, billing period, included access, and renewal terms on the purchase screen before confirming. Availability, currency, and taxes can vary by location. Website launch pricing is informational until purchases are available.

• Apple purchases: subscriptions purchased through the iOS app are billed to your Apple Account when you confirm the purchase, subject to any offer shown by Apple.
• Automatic renewal: subscriptions renew for the selected period unless canceled at least 24 hours before the current period ends. Apple may charge for renewal within the 24 hours before expiration. The purchase confirmation and Apple subscription settings show the applicable renewal price and date.
• Manage or cancel: on your iPhone, open Settings, select your name, then Subscriptions and PitchTactix. Cancellation generally stops the next renewal; access normally continues through the paid period, subject to Apple’s terms. Uninstalling PitchTactix, stopping use, or deleting your account does not automatically cancel a subscription.
• Trials and offers: any eligibility rules, duration, and post-offer price are shown before purchase. If a trial is offered, cancel before its stated deadline to avoid a charge. Annual-plan savings described as “months free” are a comparison with monthly billing, not a separate free trial unless explicitly stated.
• Restore access: use the same Apple Account that made the purchase and the restore-purchase option provided in the app when available. Contact support if eligible access is missing. Restoring a purchase does not restore deleted training records.
• Refunds: requests for Apple-billed purchases are handled through Apple’s refund process and applicable law. These Terms do not remove statutory refund or cancellation rights.
• Price or plan changes: changes are subject to the notice, consent, and cancellation rights required by Apple and applicable law. The terms shown in Apple’s purchase flow control the amount and billing period you authorize.

Coach rosters: Coach plans include the stated number of active pitchers. Additional active-pitcher access may carry a separate recurring monthly charge, including when the base plan is annual. Any such charge, quantity, and renewal terms must be disclosed and confirmed before purchase. Archiving preserves history and is not a request to erase an athlete’s information. Do not rotate profiles or misuse accounts to evade disclosed roster or billing limits.

5. Apple app license

For the app distributed through Apple’s App Store, the Apple Standard Licensed Application End User License Agreement (EULA) governs the license to the app unless a separate custom EULA is presented in the App Store. These Terms supplement that license for the PitchTactix website and services; they do not replace or limit the Standard EULA. If they conflict on app licensing, the applicable EULA controls.

Awesome Sports & Entertainment LLC is responsible for PitchTactix support and the service, not Apple. Apple has no obligation to provide app maintenance or support. The Standard EULA governs the applicable license restrictions, warranty provisions, and Apple’s third-party-beneficiary rights. Your use also remains subject to Apple’s applicable usage and purchase rules.

6. Your content and acceptable use

You retain your rights in the information and content you submit. You grant us a limited, nonexclusive permission to host, store, process, reproduce, and display that material only as needed to provide the service and the sharing you request, consistent with our Privacy Policy. Posting a workout to an available community feature authorizes its display to that audience. It does not automatically give us permission to use an athlete’s image or identity in advertising.

You must have the rights and permissions needed for what you submit. Do not upload, publish, or share:

• Private athlete information or images without the required authority and consent.
• Abusive, threatening, discriminatory, exploitative, sexually explicit, or otherwise unlawful content.
• Material that infringes another person’s intellectual property or impersonates someone.
• Malware, deceptive content, spam, or instructions that endanger others.

Do not interfere with the service, bypass access or payment controls, scrape private data, or reverse engineer the software except where applicable law permits it. Report inappropriate content or misuse to customersupport@pitchtactix.app, with the relevant location and a description. Do not include unnecessary personal information. We may investigate, restrict access, or remove content that violates these Terms or the law.

7. Our content and third-party services

PitchTactix software, branding, designs, and original materials belong to Awesome Sports & Entertainment LLC or its licensors. Your permitted use does not transfer ownership of them. Do not copy, resell, or use them outside the service without permission or a legal right to do so.

Third-party sign-in, email, payment, and external websites have their own applicable terms and privacy practices. External links do not mean that we control or endorse everything on those services.

8. Availability, termination, and deletion

We may update features and perform maintenance. The service may be interrupted or contain errors. We may suspend or terminate access where reasonably necessary to address misuse, security risks, legal obligations, or a material breach of these Terms, with notice and an opportunity to resolve the issue when appropriate.

You may stop using the service at any time. For account and data requests, use the privacy and deletion instructions. Cancellation of billing and deletion of personal information are separate actions. Ending access does not waive rights or obligations that properly survive termination, including applicable payment, ownership, and legal rights.

9. Disclaimers and legal protections

To the extent permitted by law, the website and services are provided “as is” and “as available,” without a promise of uninterrupted operation, error-free content, or a particular training outcome. To that same extent, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

To the extent permitted by applicable law, Awesome Sports & Entertainment LLC is not responsible for indirect, incidental, special, or consequential losses arising from use of the service. Nothing in these Terms excludes liability that cannot lawfully be excluded, limits mandatory consumer guarantees, or overrides rights under the applicable Apple EULA.

If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. Failure to enforce a provision immediately does not waive it. Please contact us first about a concern so we can try to resolve it. These Terms do not impose mandatory arbitration or waive rights to seek remedies available under applicable law.

10. Updates and contact

We may revise these Terms as the service changes. The effective date identifies the current version. Material changes will receive additional notice and agreement where required. Changes do not retroactively remove accrued rights.
